Terms of service

These terms of service ("Terms") govern your access to and use of the Oglah website and services ("Service"), operated by Oglah, Carrer dels Almogàvers 97, 08170 Montornès del Vallès, Barcelona, Spain ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. Your account

You must be at least 18 years old and provide accurate information. You are responsible for all activity under your account and for keeping your password secure. Notify us immediately of any unauthorised use.

2. Acceptable use

You may only send email to recipients who have given you permission. You must comply with our anti-spam policy, GDPR and the laws that apply to you. You may not use the Service to send unlawful, misleading, harmful or infringing content, or to interfere with the Service or other users.

3. Your content and data

You retain all rights to your content and subscriber data. You grant us a licence to host, process and transmit it only as needed to provide the Service. We process personal data as described in our privacy policy and our data processing agreement.

4. Plans, fees and payment

Fees are set out on the pricing page or in your Custom agreement and are payable as described in our payment policy. We may change prices with at least 30 days' notice; changes apply from your next renewal.

5. Term and termination

You may cancel at any time; the Service continues until the end of the paid period. We may suspend or terminate accounts that breach these Terms, with notice where reasonably possible. After termination you have 30 days to export your data.

6. Availability and support

We aim for 99.9% monthly uptime, excluding scheduled maintenance. Support is provided by email and chat according to your plan.

7. Intellectual property

The Service, including its software, design and trademarks, is owned by Oglah and its licensors. Templates and stock images we provide may be used only within the Service.

8. Disclaimer and limitation of liability

The Service is provided "as is". To the extent permitted by law, we exclude all implied warranties and our total liability under these Terms is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential losses.

9. Changes to these Terms

We may update these Terms. Material changes will be notified by email at least 14 days before they take effect.

10. Governing law

These Terms are governed by the laws of Spain. Disputes are subject to the courts of Barcelona, without prejudice to the mandatory consumer rights of your country of residence.
